adidas Successfully Protects Its 3-Stripes Over Shoe Brand’s 2-Stripes Trademark

A European court ruling has allowed leading sportswear brand adidas to oppose a trademark registration from Belgian company Shoe Branding Europe, which constitutes two parallel stripes.

According to CNBC, Luxembourg’s General Court asserted on Thursday that Shoe Branding Europe’s trademark appeal for a dual-streak print on shoes was too similar to adidas’ iconic three-stripes design, and might confuse consumers.

The decision is in line with those of the European Union Intellectual Property Office (EUIPO), who had previously denied the Belgian shoe brand’s registrations on two occasions in 2015 and 2016.

The General Court also said that the symbol was an “unfair” leverage of adidas’ brand and that Shoe Branding Europe had not properly justified the use of the two-stripes design.
